Swiss Privacy Notice

Information for individuals in Switzerland under the revised Federal Act on Data Protection (nFADP), in force since September 2023.

This notice supplements our Privacy Policy and provides information for individuals in Switzerland under the revised Swiss Federal Act on Data Protection (FADP / nFADP), which came into force on 1 September 2023. Where this notice and the general Privacy Policy differ for individuals in Switzerland, this notice prevails.

Responsible party and representative

The party responsible for processing your personal data is the Artificial Intelligence Foundation, contactable at [email protected]. [If the Foundation is established outside Switzerland and is required to designate a representative in Switzerland under the FADP, insert their name and contact details here.]

How the FADP applies to you

The FADP gives individuals in Switzerland rights over their personal data that are broadly similar to those under the EU GDPR, with some differences. We apply the FADP's principles of lawfulness, good faith, proportionality, purpose limitation, and data security to all processing of personal data relating to individuals in Switzerland.

Your rights under the FADP

If you are in Switzerland, you have the right to:

  • Be informed about the collection and processing of your personal data;
  • Request access to the personal data we hold about you;
  • Request correction of inaccurate data;
  • Request deletion or destruction of your data, or that processing cease, in applicable circumstances;
  • Object to processing of your data;
  • Request the handover or transfer of data you have provided, in a common electronic format, where applicable;
  • Withdraw any consent you have given.

To exercise these rights, contact [email protected]. We will respond within the period required by the FADP, ordinarily within 30 days.

International data transfers

Where we transfer personal data abroad, we do so only to countries that the Swiss Federal Council recognises as providing adequate protection, or — where a country is not recognised as adequate — subject to appropriate safeguards such as Standard Contractual Clauses or other measures permitted under the FADP. [Specify the destinations and safeguards your deployed site relies upon.]

Automated individual decisions

We do not make decisions about you based solely on automated processing that have a significant effect on you within the meaning of the FADP. Should this ever change, we will inform you and respect your right to express your point of view and to request review by a natural person.

Federal Data Protection and Information Commissioner

If you believe your data protection rights under Swiss law have been infringed, you may contact or lodge a report with the Swiss Federal Data Protection and Information Commissioner (FDPIC). We would welcome the opportunity to address your concerns directly first.
